What problems may arise after executing a mobile application development agreement. Unless you negotiate it otherwise, the intellectual property ownership rights in software belong to the developer. All too often businesses make the mistake and believe that because they hire a developer to create or build an app or software that they own all of the software code and intellectual property rights. Unfortunately, this is not the case as developers use generic code to create or develop an app, and they can and likely will reuse this code for other clients. Businesses sign agreements with developers believing that they own 100% of whatever was developed only to find out the hard way later that the license they have does not allow for all of their intended uses of the code.
Another major problem is with the acceptance testing or beta testing of the code. It is common in the software development process that the code has bugs and other issues that need to be worked out and fixed by the developer. That’s why you should insist in the app development contract that the developer create a testing environment on a server giving you time to test and see if the software works properly according to the scope of work and milestones and to put the developer on notice that it has to fix all the bugs and defects.
